Terms of Use

These Terms of Use ("Terms") govern your use of the Fantasia AI mobile application and related services (together, "Fantasia" or the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 17 years old and meet the App Store age requirement applicable in your region. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must accept these Terms for you. Do not use likeness, voice, or other real-person features unless you are legally able to provide the required permissions.

2. Guest and Linked Accounts

Fantasia starts with a guest account. You may optionally link it using Apple or Google. You are responsible for activity through your account and for keeping linked credentials secure. Guest data may be lost if you delete the app, change devices, or lose access before linking. Notify support@fantasiaai.app about suspected unauthorized use.

3. AI Service

Fantasia provides AI-assisted image, video, audio, writing, and editing tools. Outputs are probabilistic and may be inaccurate, incomplete, offensive, or different from your request. You are responsible for reviewing outputs before using or sharing them. We may add, change, limit, or discontinue features and providers.

4. Subscriptions, Credits, and Refunds

• Digital features, subscriptions, and credit packs are purchased through Apple In-App Purchase and are subject to Apple’s applicable purchase terms.
• Before purchase, the app displays the price, subscription period, included benefits, and renewal information. Subscriptions automatically renew unless cancelled through your Apple account settings at least 24 hours before the end of the current period.
• Generation requests consume the credit amount displayed before submission. Credits are ordinarily returned when our systems record a provider or processing failure, but not merely because an otherwise completed output differs from your preference.
• Credits and entitlements are personal, non-transferable, have no cash value, and may not be resold. Promotional credits may expire if their offer states an expiration.
• Apple processes charges, cancellations, and refund requests. Manage subscriptions at Apple Subscriptions and request eligible refunds through Report a Problem.

5. Your Content and Permissions

You retain your rights in content you upload. You grant Fantasia and its processors a limited, worldwide license to host, copy, transmit, modify, and process that content only as needed to operate, secure, and improve the requested Service and comply with law.

You represent that you have all rights and permissions needed for every upload and instruction. For any identifiable person, you must have valid permission to use their image, likeness, voice, and other personal attributes for the requested purpose. Ownership of a photo or video does not necessarily grant permission to use the depicted person’s likeness.

6. Prohibited Use

You may not use Fantasia to create, upload, request, or distribute content or activity that:

• Sexualizes, exploits, endangers, or depicts the abuse of a minor, including apparent CSAM.
• Creates nonconsensual intimate imagery or uses a person’s likeness or voice without required consent.
• Deceives, defrauds, impersonates, harasses, threatens, defames, or facilitates violence or other unlawful harm.
• Infringes copyright, trademark, privacy, publicity, or other rights.
• Introduces malware, probes or disrupts the Service, evades access controls, automates unauthorized access, or attempts to bypass safety systems.
• Violates applicable law, sanctions, or platform rules.

7. Moderation and Enforcement

We may screen prompts and selected media, reject or quarantine content, limit features, preserve evidence, and suspend or terminate access when reasonably necessary to enforce these Terms, protect people, or comply with law. High-confidence apparent CSAM may be reported to the NCMEC CyberTipline with available content and metadata. Automated systems can make mistakes; contact support if you believe an enforcement decision was incorrect.

8. Output Rights and Responsibility

As between you and Fantasia, and to the extent permitted by applicable law, you may use completed outputs created for you. We do not promise that an output is copyrightable, unique, non-infringing, or available for every commercial purpose. Similar outputs may be generated for others. You are responsible for determining whether your intended use is lawful and for providing disclosures or labels required for synthetic media.

9. Copyright Complaints

Our Copyright & DMCA Policy explains how to submit a copyright notice or counter-notice. We may remove material and terminate repeat infringers where appropriate.

10. Third-Party Services

Fantasia relies on Apple and other providers described in our Privacy Policy. Their services and terms may apply to your use of their features. Fantasia is not responsible for third-party services outside our control.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FANTASIA DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTASIA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOST PROFITS, DATA, OR GOODWILL. FANTASIA’S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE LIMITS APPLY ONLY TO THE EXTENT PERMITTED.

13. Indemnity

To the extent permitted by law, you will defend and indemnify Fantasia against third-party claims arising from your content, your use of a person’s likeness or voice, your violation of these Terms, or your violation of another person’s rights.

14. Suspension, Termination, and Changes

You may stop using Fantasia and delete your account at any time. We may suspend or terminate access for violations, safety risks, legal requirements, nonpayment, or material harm to the Service. We may update these Terms and will provide notice of material changes when required. Changes apply prospectively from their stated effective date.

15. Governing Law

These Terms are governed by the laws of North Carolina, excluding conflict-of-law rules, except where the law in your place of residence requires otherwise. Nothing in these Terms limits non-waivable consumer rights.
